When President Trump tweeted out he will take his impeachment case to the Supreme Court if necessary, he was mocked by Democrats and liberals alike.
Legal expert Alan Dershowitz is telling them all to pump the brakes because Trump is actually right in this case. In fact, Dershowitz indicated that the Supreme Court has the power to remove the charges.
Take It to the Court
Under certain conditions, President Trump actually has a case, stated Dershowitz. To make his point, Dershowitz cited former Supreme Court Justice Byron White.
White stated, “Finally, as applied to the special case of the President, the majority argument merely points out that, were the Senate to convict the President without any kind of trial, a Constitutional crisis might well result.”
His point being if Democrats try to circumvent the process, Trump stands on firm ground to call on the Supreme Court to rectify the situation.
This, of course, assumed the Democrats move ahead with the impeachment.
Pelosi Still Reluctant
While the impeachment movement continues to grow within the Democrat party, Speaker of the House Nancy Pelosi continues to try to stave off real action.
At the moment, Pelosi stated there were roughly three dozen Democrats in the House that want to move forward with impeachment. That is a far cry from the votes necessary push the impeachment through.
Additionally, there is the challenge of getting the impeachment through a Republican-controlled Senate. For now, Trump seems to be safe, but that could change depending on how the 2020 election plays out.
If, for instance, Trump were to lose the election, this would probably just go away. If Trump were to win the election with Republicans maintaining control of the Senate and recapturing the House, it would also go away.
Worst case scenario, however, at least in terms of impeachment, would be Trump winning while the Republicans lose control of the Senate.
If that happens, you can bet your bottom dollar Democrats will be energized and move forward with impeaching Trump.
