Democrat senator takes credit for SCOTUS defending the ACA, says party’s ‘warnings’ were key

Since former President Donald Trump had the unprecedented duty of appointing three U.S. Supreme Court justices, some have claimed that in response to his conservative selections, worried Democrats have essentially threatened the high court.

In a piece published by the Washington Examiner, commentary fellow Zachary Faria revealed a chilling recent instance in which Sen. Sheldon Whitehouse (D-RI) seemed to celebrate Democrats “warning” SCOTUS during then-nominee Amy Coney Barrett’s confirmation hearing about the possible consequences of not upholding certain pieces of legislation, such as former President Barack Obama’s Affordable Care Act (ACA). 

What happened?

Faria pointed to an interesting tweet published by CNN chief congressional correspondent Manu Raju shortly after the high court saved Obama’s ACA last week in a shocking 7–2 decision. In it, Raju claimed that Whitehouse told him that he didn’t regret the rhetoric Democrats used at the time.

In a follow-up tweet, Raju went on to say that Whitehouse went as far as telling him that if Democrats hadn’t focused on using rhetoric in which they predicted Barrett would kill the ACA, along with issuing “warnings” about doing so, the law might have actually been ruled against in the latest decision from the high court.

In other words, Faria wrote, Whitehouse “took credit on behalf of the Democratic Party for intimidating the court into protecting Obamacare.”

Other types of threats

Faria went on to point to various examples of other high-level Democrats who’ve either outright or subtly attempted to intimidate the Supreme Court because of its heavily stacked conservative majority, including disturbing comments last year from Whitehouse.

“The Supreme Court is not well. And the people know it. Perhaps the court can heal itself before the public demands it be ‘restructured in order to reduce the influence of politics,'” Whitehouse said at a time when Democrats were kicking around the idea of “packing” the high court to dilute its considerable conservative influence.

Faria also reminded readers that Senate Majority Leader Chuck Schumer (D-NY) seemingly physically threatened Trump’s trio of high court appointees over the issue of abortion.

“I want to tell you, Gorsuch, I want to tell you, Kavanaugh: You have released the whirlwind, and you will pay the price,” Schumer said at the time. “You won’t know what hit you if you go forward with these awful decisions.”

It’s not surprising that Democrats continue to intimidate the SCOTUS at every opportunity, because it’s the last bastion of power that they currently do not control in Washington D.C. Hopefully, that changes after the 2022 midterms, but between now and then, a lot of scary things can happen.
