Ben Rhodes, one of former President Barack Obama’s top foreign policy advisers, confirmed that Democratic presidential candidate Joe Biden is already talking to foreign governments about his planned agenda.
In an interview Monday on MSNBC, Rhodes confirmed the rumors that Biden was talking to foreign governments. President Donald Trump’s former National Security Advisor Michael Flynn was nearly sent to prison for doing the same thing back in the transition period after the 2016 presidential election.
Biden has not been certified as the president-elect and until he is sworn in on Jan. 20, he should not be talking to foreign leaders and undercutting President Trump.
Potential Logan Act violation
The Logan Act of 1799 prohibits negotiation by citizens of the U.S. with foreign countries to prevent the president and his cabinet from being undercut or weakened.
The text of the Logan Act reads as follows, “Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or of any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both.”
Michael Flynn, the former United States national security advisor in the Trump administration, was accused of violating the Logan Act after talking to the Russian ambassador before Trump had been sworn into office. Democrats cried foul and alleged that the incident was proof of secret dealings between Moscow and the Trump campaign.
Biden himself, who was still the vice president of the United States, jumped on the opportunity to attack the president-elect and his cabinet. It would take years for Flynn to clear his name after the FBI tried to frame him.
Rhodes said during his interview on MSNBC that, “Foreign leaders are already having phone calls with Joe Biden, talking about the agenda they’re going to pursue January 20th. If that reality hasn’t sunk in yet for some people in the White House, it will sink in when they have to leave on January 20th.”
Tip of the iceberg
Before Biden has even been confirmed as the president-elect, he is negotiating and talking with foreign governments. It doesn’t exactly take a law degree to understand how that is a violation of the Logan Act. This wouldn’t matter if Democrats hadn’t dragged the 200 year old act back from the dead to go after Flynn three years ago.
If anything has been made clear about the last four years, it’s that Democrats are the masters of gaslighting. They continually accuse Trump and Republicans of doing the very things they did for years — and with Biden that pattern will continue.
To the media and the Democrats, civilians negotiating with foreign governments is only a problem when those civilians are Republicans. Democrats are free to do as they please and Rhodes will justify it.
If Biden does eventually win the election and ascend to the presidency, expect the flaunting of the law to continue. The media will not hold Biden accountable and neither will the Democratic Party.
