Republican Texas Gov. Greg Abbott took executive action meant to restrict the dropoff of undocumented immigrants at hotels and shelters across his state amid reports that COVID-infected individuals had been responsible for spreading the virus.
The Bided administration responded by filing a lawsuit — and a federal judge imposed a 10-day injunction preventing the governor’s order from being implemented or enforced.
“Risking the safety of federal law enforcement personnel”
According to the Washington Times, the ruling from U.S. District Judge Kathleen Cardone determined that the Biden administration was likely to win its challenge against Abbott’s order.
In the interim, the judge said that enforcing the order could cause “irreparable harm” to the federal government.
Her two-page ruling on Tuesday asserted that Abbott’s order “violates the Supremacy Clause of the United States Constitution because (1) it conflicts with, and poses an obstacle to, federal immigration law; and (2) it directly regulates the federal government’s operations.”
Cardone further concluded that the Texas order jeopardizes “the health and safety of non-citizens in federal custody, risking the safety of federal law enforcement personnel and their families” while exacerbating “the spread of COVID-19.”
Of course, it is exactly those issues that Abbott said he was attempting to address in issuing the contested order.
“We will get to put out the evidence”
The judge acknowledged that more evidence is necessary to reach a final conclusion, limiting her own injunction until Aug. 13, at which time another hearing would be held to presumably allow both sides to present their arguments.
In a statement, Abbott responded to the ruling by calling it “temporary and based on limited evidence,” expressing confidence that he will prevail in the long run.
“The Biden Administration has knowingly– and willfully — released COVID-19 positive migrants into Texas communities, risking the potential exposure and infection of Texas residents,” the governor added. “The Governor’s Executive Order attempts to prevent the Biden Administration from spreading COVID-19 into Texas and protect the health and safety of Texans.”
As Politico reported, Abbott made a similar case during a recent Fox News Channel appearance.
“We will have a full hearing in the coming weeks where we will get to put out the evidence about how the Biden administration is exposing Texans to thousands of migrants who are bringing COVID-19 into the United States of America,” he said.
