Judge allows Trump lawyers to refer to Trump's presidency as his 'first term'

 March 31, 2024

A judge is allowing former President Donald Trump's legal team to refer to Trump's presidency as his "first term."

This is a major blow to President Joe Biden, Special Counsel Jack Smith, and the Democrats. Read on to see why.

Newsweek reports that this is taking place in the classified documents case that Smith has brought against Trump. Smith claims that the former president illegally mishandled classified materials when he left the White House and that he obstructed efforts to get the materials to the proper authorities.

Trump has denied these claims, and he has insisted that Smith is running election interference for Biden, considering that Trump and Biden are facing off against each other in the 2020 general election.

A sudden change

Newsweek reports that Trump's legal team only recently started referring to Trump's presidency as his "first term."

"Trump's legal team filed a seven-page document to the U.S. District Court for the Southern District of Florida, where he will stand trial in the classified documents case, on March 24. This was done in support for his controversial bid to get the charges dismissed on the basis of presidential immunity," the outlet reports.

It continues, "In the filing, the former president's team twice refers to 'President Trump's first term,' language which was not used for previous filings."

Newsweek then quotes the relevant portions of the filing.

On page two, Trump's lawyers wrote, "In two court filings in this case, the Office has conceded that these alleged decisions occurred during President Trump's first term." And, on page five, they wrote, "alleged actions and decisions during the 'tail end' and 'eleventh hour' of President Trump's first term."

Why this change is important:

By referring to Trump's presidency as his "first term," Trump's lawyers are implying that there will be a second term - that Trump will win the 2024 presidential election.

The reason why this is such a huge blow to Biden, Smith, and the other anti-Trump lawyers and judges who are trying to take Trump down is that, every time Trump's lawyers refer to his presidency as his "first term," they are actually suggesting to Biden, Smith, and the others that their attempts to use the legal system to stop Trump will fail, because Trump is going to have a second term.

It is a subtle but significant change.

As we have seen in the polls, the legal persecutions of Trump by Biden's allies have, thus far, only backfired on Biden. Trump's popularity has only gone up, presumably because Americans see these prosecutions for what they are - namely, baseless attempts to prevent Trump from winning the presidency.

We're getting closer and closer, now, to learning whether Trump is going to get that second term.
