The judge in former National Security Advisor Michael Flynn’s case, Emmet Sullivan of the D.C. District Court, has been ordered to respond to Flynn’s writ of mandamus petition, Breitbart reported Thursday.
According to Breitbart, the petition was filed by Flynn’s lawyers, who are seeking for Sullivan to grant the Justice Department’s motion to dismiss the charges of perjury against the former Army general.
Not only must Sullivan respond to the motion, but he also is facing removal from the case entirely, as CNBC notes.
Justice for Flynn
Sullivan has so far refused the Justice Department’s motion to dismiss the case, according to CNBC. Now, some have begun to suspect that the judge has political motivations.
According to The Hill, Sullivan has previously told Flynn, “Arguably, you sold your country out. I’m not hiding my disgust, my disdain, for this criminal offense.”
Sullivan later had to issue a correction to his rebuke; Flynn had ended his lobbying activities before he went to work in the Trump administration, reports noted.
It is clear that Sullivan has been harsh with Flynn, which, at the time, appeared justified. But with all the new information and evidence that has emerged, Sullivan should be fighting to exonerate Flynn, just as Attorney General Bill Barr is doing.
Sullivan’s refusal to deliver justice to a clearly innocent man should cast doubt on his ability to carry out his duties as a judge.
Making a comeback?
Flynn has spent years fighting to clear his name. He has continued to serve our country by exposing corruption in the FBI. In that light, righting the wrong against Flynn must start at the top.
It isn’t enough to have this case dismissed; there must be a precedent set to ensure this never happens to another innocent American.
“Look at what they did to the guy [Flynn],” President Donald Trump previously said, according to Politico. “I mean, he couldn’t have known too much [about] what was happening. They came at him with 15 buses, and he’s standing in the middle of a highway. What they did to this man, they tormented him. They destroyed him. But he’s going to come back. Like I say, he’s going to come back bigger and better.”
Trump himself has a great opportunity to drain the swamp and root out corruption in our nation’s institutions. The time for words has passed; Flynn deserves strong actions. Justice in America is at stake.
