The Supreme Court has ruled against the testimony of asylum-seekers as credible, handing the federal government a big victory, the Washington Examiner reported.
The Court found that the California-based U.S. Court of Appeals for the 9th Circuit had wrongly decided that noncitizens’ testimonies should be treated as credible or true in immigration cases. Justice Neil Gorsuch commented that “The Ninth Circuit’s rule has no proper place in a reviewing court’s analysis.”
This isn’t the first time the Supreme Court has had to intervene and correct the actions of the 9th Circuit court.
The conservative majority on the Supreme Court has brought about an era of thorough enforcement in place of the judicial activism that ran rampant for the past few decades.
No longer can judicial bodies like the 9th Circuit throw aside the rule of law in favor of their ideological desires. In this case, the 9th Circuit attempted to interfere in the procedures that are under the jurisdiction of immigration judges and the Board of Immigration Appeals.
The Supreme Court has become extremely involved in ongoing immigration issues as President Joe Biden and his administration have taken a flamethrower to former President Trump’s immigration policies.
While Biden repealed many of Trump’s executive orders, his administration has also made policy changes that have prompted significant legal conflict.
The Supreme Court’s decision to reverse the rule that compelled judges to assume asylum seekers are telling the truth in their testimonies was the right one. This is but one of many steps that the Supreme Court needs to take to set the immigration system right.
Thanks to the politics surrounding immigration policy, the Supreme Court has a nightmare to unravel in fixing the legal environment around immigration.
The Supreme Court will likely find themselves having to step in to fix Biden’s immigration crisis as both Biden and Vice President Kamala Harris have chosen to ignore the situation.
Thousands of immigrants have rushed the border, and thousands of unaccompanied minors are overwhelming detention facilities. Biden’s refusal to properly crack down on the situation and deport illegal immigrants has signaled that the border is open.
Harris was appointed to fix the situation, but she has gone months without even addressing the issue in front of the media. Things will only get worse, and it will likely be up to the judiciary to fix this mess.
