California officials have agreed, in a court stipulation, not to try to censor the parody works of the Babylon Bee and others while a lawsuit over a new speech limit pushed by Gov. Gavin Newsom develops in the court system.
The Bee, a satire website, and several others, are suing the state over two new laws that purport to limit Americans' speech, specifically setting restrictions for political satire and parody.
"California's war against political memes is censorship, plain and simple. We shouldn't trust the government to decide what is true in our online political debates," explained Jonathan Scrubbs, an ADF lawyer working on the case.
"Gov. Newsom has no constitutional authority to act as the humor police. While lawmakers act as if posting and resharing memes is a threat to democracy, these laws censor speech California politicians don't like. We are grateful that California's unconstitutional law can no longer be applied to censor The Babylon Bee and Ms. Rickert while the case continues and that they are again free to exercise their First Amendment rights to poke fun at political leaders."
The agreement comes in a stipulation in which, the case having been transferred to a federal court in the Eastern District of California, state officials agreed that a previously issued preliminary injunction still protects the Babylon Bee and Rickert.
A lawsuit was filed that challenged the state's demands that it control online content such as political satire and parody.
Newsom launched the laws, AB2839 and AB2655, just weeks ago.
They use "vague standards" that officials wanted to impose to punish people for posting certain political content, such as political memes and parodies.
WND previously reported when the original judge issued the injunction.
A second case, brought on behalf Chris Kohls, known as "Mr. Reagan" online, also addressed the same problem.
The original judge said the law "hinders humorous expression and unconstitutionally stifles the free and unfettered exchange of ideas."
WND previously reported as the battle heated up and Newsom, who has faced mockery for his state's high taxes, extremism on social issues like abortion and transgenderism, attempts to interfere with other states and their rights, took chutzpah to a new level.
That, by the way, derives from a Hebrew word meaning "insolence," "cheek" or "audacity."
He signed a law banning parody.
The report said video creator Kohls charged Newsom with violations of the First and 14th Amendments with Newsom's "anti-deepfake measure" that was signed into law this week.
California's governor was offended by a parody released by "Mr. Reagan" recently:
In it "Kamala Harris" confirms she is the Democrat candidate for president because Joe Biden "exposed his senility at the debate."
She confesses she is the "ultimate diversity hire," as a woman and a "person of color."
"So if you criticize anything I say you're both sexist and racist."
The mockery continues.
The video uses AI-generated audio clips, and it was shared by Elon Musk, collecting more than 100 million views.
Newsom responded:
The lawsuit in federal court in California charges that Newsom's scheme is a flagrant use of "state power to force private social media companies to censor private citizens' speech by purging election-related AI-generated content."
Musk's comment? "You're not gonna believe this, but Gavin Newsom, just announced that he signed a LAW to make parody illegal, based on this video."
He concludes California needs "new leadership."
However, taking on Newsom directly was the Babylon Bee, which prominently announced it has "'obtained this exclusive, official, 100% real Gavin Newsom election ad."
In it, "Newsom" states:

In a bold and controversial move, Israeli Prime Minister Benjamin Netanyahu ordered a military operation in Rafah that resulted in the elimination of Yahya Sinwar, a key Hamas leader, against strong warnings from U.S. leaders, Fox News reported.
This operation met with criticism and support, has reshaped security dynamics in the Middle East and highlighted tensions between U.S. and Israeli strategies, as Netanyahu ignored President Joe Biden and Vice President Kamala Harris' warnings not to take action in Rafah.
The operation in Rafah was launched despite earlier cautions from President Biden and Vice President Harris. Nonetheless, the Israeli Defense Forces (IDF) and Shin Bet confirmed that the operation successfully resulted in Sinwar’s death.

California Democratic Rep. Adam Schiff has always been quick to criticize his political opponents on a variety of topics, but he now faces notable potential legal issues of his own.
According to JustTheNews, Schiff has claimed his "principal" residences in mortgage and election filings as being in California and Maryland.
However, Americans are only allowed to claim one residence as their principal residence, and Schiff has reportedly claimed both homes in the aforementioned paperwork dating back to 2003.
The revelation has sparked the possibility of an ethics investigation that could ultimately promote prosecutable charges, according to reports.
The outlet explained the fact that American citizens can only claim one home as their "principal" residence. Schiff apparently believes the rules do not apply for his circumstance.

Americans are allowed to claim just one home as their primary residence: the one they live in the majority of the year, according to the federally backed lender Freddie Mac. But Schiff alternately declared both of his properties in the two different states as “principal” on multiple mortgage and election forms dating to 2003 and reviewed by Just the News.
One of the problems -- of many -- is that by doing what he did, Schiff was able to score "financial and political benefits like lower mortgage interest rates, tax advantages and the ability to run for election in a California House district."

In at least three instances, documents show that in 2009 and again in 2011 and 2013, Schiff refinanced his Maryland home and declared it was his “principal residence” at the same time he had declared his principal residence was in the California, according to 2009 and 2011 financing docs for his Burbank condo.
Sacramento-based real estate investigator Christine Bish, who also happens to be running for Congress as a Republican, first uncovered the situation.
Bish has already filed an ethics complaint against Schiff.
Schiff might have already ratted himself out due to a peculiar change he made in his 2020 filings, where he lists his Maryland residence as a "secondary" residence.
Bish argued that such a change is nothing less than a full admission of what he has been accused of doing.
Retired FBI supervisory special agent Jeff Danik reviewed the documents at the request of JustTheNews, and he believes there are potential charges to be filed.
"These are serious, documented allegations which carry significant criminal penalties if substantiated," Danik told the outlet.
Though Democrats have slammed former President Donald Trump for highlighting a rise in crime during the Biden-Harris administration, the recent experiences of one New England town are proving particularly instructive in countering the left's narrative.
As Fox News reports, conditions in Burlington, Vermont, have deteriorated significantly in recent years, a fact which locals attribute to homelessness, drug addiction, and rising rates of crime that remain unaddressed by federal policies.
Local residents of Burlington spoke with Fox News Digital last week, detailing their frustrations with the homelessness and drug use that have both gripped their hometown.
Many noted the unease with which they now approach the city's downtown area, with some expressing fears for their physical safety.
The influx of fentanyl, and the addictions it has spawned, have prompted a rise in crime that has left community members shaken and seeking solutions.
According to one young man from Burlington, “It's really good during the day, but during the night, like people have said, it's really dangerous” due to the desperation drug use and addiction causes in affected individuals.
With drugs such as fentanyl and “tranq” becoming more prevalent, Vermont has marked a 500% increase in overdose deaths over the last decade, with first responders strapped for the resources necessary to properly respond to the volume of assistance needed.
Nancy, an elderly resident of Burlington, admitted, “I don't walk at night,” and when pressed for a reason, she stated, “Cause it's dangerous.
“People get beat up at nighttime,” she observed, adding that her neighbor was assaulted in such brutal fashion that the attackers also tried to destroy the individual's wheelchair.
A local entrepreneur placed blame on what she characterized as misplaced priorities among those in power, telling Fox News that emphasis is being put on all the wrong things.
“There seems to be a lot of focus in this town and by the government on helping people who are addicted. There seems to be a lack of respect for people who are doing business, you know, who are trying to run a store,” said the woman.
After having slashed law enforcement budgets in recent years, the city is reportedly now attempting to hire additional police officers to address growing concerns.
Burlington's story is perhaps illustrative of Donald Trump's recent claims that, despite Democrats' claims to the contrary, violent crime has been on the rise during Biden's time in office, even though ABC's David Muir attempted to fact-check the former president on that argument during his September debate with Kamala Harris.
Interestingly, the FBI itself recently had to revise its own figures -- cited by Muir against Trump -- to show an overall growth in criminal offenses for the year 2022, as the New York Post noted, and though the agency attempted to keep the changes as quiet as possible, they serve as concrete validation of the troubling phenomenon with which Burlington residents are all too familiar.
As we enter the final weeks before the next election, Vice President Kamala Harris has a growing number of PR fires to put out while she attempts to convince Americans to vote her into the White House.
According to the Daily Caller, the latest nightmare for Harris and her campaign is her "close" association with a California Democrat who "tried to make child pornography possession a non-felony in California."
Harris has gone on record of calling Mark Leno, a former California state senator, a "dear friend" according to the outlet.
Former Republican House Speaker Kevin McCarthy (CA) said Leno "authored a piece of legislation that would have allowed pedophiles to possess up to 99 items depicting child pornography before they could be charged with a felony," the DC reported.
McCarthy was serving as the California Assembly Republican leader at the time Leno was pushing the legislation.
The legislation was already bad enough, but there were even more disturbing loopholes, such as one compact disc, which could contain thousands of those types of images, would only count as one of the 99 allowed "items."
The legislation was heavily criticized by Republicans and even received pushback from top Democrats.

"What the Democrats did on AB 50 was insane, insane – 100 exemptions for child porn? They had to figure out this was not good? If this seeps into voters’ minds, my God," California Democrat Pat Caddell told the Los Angeles Daily News in 2006.
The same outlet heavily criticized the legislation, writing in one opinion piece, "Early on, AB 50 was filled with loopholes that would make your skin crawl. For instance, Leno provided an ‘exemption’ from felony charges if a suspect was caught with less than 100 pieces of child pornography. In a creepy all-time low, Assembly Democrats voted for Leno’s plan to go soft on child porn."
Users across social media reacted to the news of Harris' close ties with Leno.
"Under Kamala's watch literally 100s of 1000s of children migrants are unaccounted for (read trafficked) Now it seems she's okay with child porn purveyors. That woman has some sick friends," one X user wrote.

Only time will tell what else is revealed about Harris as the election inches closer.
The man charged with trying to assassinate Donald Trump at his Florida golf course has asked the judge to recuse herself from the case.
Attorneys for Ryan Routh asked Judge Aileen Cannon, a Trump appointee, to step aside to eliminate perceptions of bias.
Lawyers for Routh asked Cannon to step aside, arguing Trump's praise of her rulings could create doubts about her impartiality.
"By repeatedly and publicly praising this Court by name for its rulings in his case, Mr. Trump has arguably bolstered the perception that the Court is partial in his favor. Moreover, were Mr. Trump to become President again in the future, he would be in a position to nominate Your Honor to a vacancy on a higher appellate court, including the U.S. Supreme Court," the lawyers said.
"In the mind of the public, this prospect of a judicial promotion could arguably affect this Court’s ability to be impartial in this case, where Mr. Trump is the alleged victim and has an interest in the outcome," the motion said.
Cannon was appointed to the federal bench by Trump in 2020. She rose to prominence last year for her role in Trump's federal classified documents case.
Trump won a significant legal victory when Cannon dismissed his classified documents case in July. The judge ruled that Special Counsel Jack Smith was improperly appointed.
Cannon was randomly selected to oversee Routh's trial following his arrest in September for attempting to kill Trump at his West Palm Beach golf course.
A Secret Service agent noticed the barrel of Routh's rifle, and he fled the scene as agents fired their guns at him. The assassination attempt came only weeks after Trump was left bloodied by a sniper's bullet in Butler, Pennsylvania.
Routh spelled out his intention to kill Trump in a letter bashing Trump as "totally unfit" to be president.
“This was an assassination attempt on Donald Trump but I failed you,” the letter read. “Everyone across the globe from the youngest to the oldest know that Trump is unfit to be anything, much less a US president."
Trump has blamed the assassination attempt on inflammatory rhetoric from his Democratic rival, Kamala Harris, and her allies.
Despite the threats against his life, Democrats have continued to paint Trump as a threat to democracy in the final days before the election.

President Donald Trump, at the Al Smith Charity Dinner in Manhattan, a tradition for presidential candidates, took a few moments of his speech to express his faith.
He's been derided by Democrats and other leftists for being crude at times, but he closed his speech with revelations about his own beliefs.
"You don't hear about the American Dream anymore. We're going to make it possible for them to have that dream again. This is a very religious evening for me. It really is. It represents so much. My sister was someone who loved the (Catholic) Church and gave to the Church. The cardinal knew that," he said.
"Having recently, myself, survived two assassination attempts—yes, I survived. I have a chart that went down to the right. Fortunately, I looked at it. It's my all-time favorite piece of paper. It went down, and I looked to the right, and I said, 'Was that luck? Was that God?' I think it was God that did that. I really do.
"But I have a very fresh appreciation for how blessed we are by God's providence and His divine mercy. I mean, that was something. I wasn't supposed to be here tonight, that I can tell you. With God's help, I know there is nothing we cannot achieve. We can achieve so much good for this country and get together and unify.
"I want to thank the Al Smith Foundation for its noble work, and I want to express my tremendous gratitude to the Catholic community. It's a great community, one I've gotten along with all my life":
Kamala Harris, invited, only sent a video statement to the event, which hadn't been skipped by a presidential candidate since Walter Mondale gave it the thumbs down, and subsequently lost the election.
The Gateway Pundit posted online a full transcript of Trump's address, which did document how he can turn snarky about his opposition in the 2024 presidential race.
The "top jabs," listed by the publication included, ""Well, I'd better wrap up because Mayor Adams told me earlier that I needed to make this one very quick, especially the city has reserved this room for a large group of illegal aliens coming in from Texas."
He took several opportunities to make fun of the pro-transgenderism agenda adopted by the Biden-Harris regime:
"Chuck Schumer is here looking very glum. He looks glum. He looks glum. But look on the bright side, Chuck, considering how woke your party has become. If Kamala loses, you still have a chance to become the first woman president."
And he joked about the Democrats' extensive lawfare campaign against him, in which they've weaponized the Department of Justice and multiple local prosecutors to bring various wild charges against him.
"These days, it's a pleasure to be anywhere in New York without a subpoena for my appearance. Any time I don't get a subpoena, I'm very happy," he said.
And he ridiculed the media, with, "But I have to be careful, though, because this will be the first time in the history of this event where jokes will be fact-checked."
He cited Harris' absence: "It's been a long tradition for both Democratic and Republican candidates for president of the United States to attend this dinner. Always, it's a rule. You got to go to the dinner. You got to do it. Otherwise, bad things are going to happen to you from up there. You can't do what I just saw on that screen. But my opponent feels like she doesn't have to be here, which is deeply disrespectful to the event and, in particular, to our great Catholic community. Very disrespectful.
"The last Democrat not to attend this important event was Walter Mondale, and it did not go very well for him. He lost 49 states and only won one—Minnesota. So I said, 'There's no way I'm missing it.'"
He continued, "And we are doing well, by the way. The votes are starting to come in. You've got to get out and vote. Catholics, you've got to vote for me. Just remember, you better remember—I'm here, and she's not. I could have skipped this, but I didn't. You do something that's incredible—the Catholic Church—you're helping the poor, educating children, and supporting the vulnerable. But if you really wanted Vice President Harris to accept your invitation, I guess you should have told her the funds were going to bail out the looters and rioters in Minneapolis. Then she would have been here, guaranteed. She would have been here. Guaranteed."
He also addressed Harris' interview with Fox News' Bret Baier, in which she essentially refused to answer any of his questions, instead diverting to other topics.
Trump said, "And as you may have seen, Kamala did an interview on Fox News yesterday. It went so poorly for her that the Democrats have been forced to install another 100 drop boxes throughout the city. And the upside is, Kamala now sees the benefit of deportation. She wants to deport people—she's vicious! She wants to deport people, and she wants to start by deporting Bret Baier from Fox."

Joe Biden bragged Wednesday about Donald Trump's criminal sentencing - after Trump repeatedly accused Biden and Democrats of weaponizing the justice system against him.
Biden's troubling remarks came as Kamala Harris has tried to paint Trump as an authoritarian figure who would lock up his political opponents.
Speaking at a rally for Harris in Pennsylvania, Biden recited the litany of civil and criminal cases that have been filed against Trump.
"And folks, look. This is the same guy who’s been held liable for $83 million for sexual abuse and defamation, the same guy for getting rid of Roe V. Wade, the same guy with three other major cases waiting for him when he loses," Biden said.
All four of Trump's criminal indictments were filed last year, after Trump launched his presidential campaign. The prosecutions have mostly stalled, with the exception of Trump's "hush money" case in New York, where he was convicted in May for "falsifying business records."
A Justice Department insider privately called the case "nonsense" and suggested Manhattan District Attorney Alvin Bragg was motivated by ambition.
Biden, in his remarks, said he looks forward to Trump's November 26 sentencing, which was delayed until after the election.
"And by the way, 34 felonies, and so far — he had to get sentenced. He got the sentence kick back, but I want to watch that sentence. Look, Donald Trump is not running for you. He’s running for himself. I think he’s running to stay out of jail."
Democrats have repeatedly accused Trump of wanting to weaponize the justice system - although Trump says that's exactly what Democrats have done to him.
Just weeks before Election Day, DOJ prosecutor Jack Smith publicly released evidence against Trump in his stalled January 6th case. Smith's move has been seen as an improper attempt to influence the election and try the case in the court of public opinion.
In addition to his criminal prosecutions, Trump has also been fined upwards of half a billion dollars in two separate civil cases. An appeals court recently suggested it might reverse the verdict in the "business fraud" case, calling the gargantuan $454 million punishment "troubling."
Biden's unseemly gloating comes despite Harris' repeated warnings that Trump is a threat to democracy and the rule of law.
"This is a democracy, and in a democracy the president of the United States in the United States of America, should be willing to be able to handle criticism without saying he'd lock people up for doing it," she told Fox News' Brett Baier Wednesday night.
Trump has long blasted the avalanche of legal cases as politically motivated and a threat to free and fair elections.

Democrats have been campaigning for months on their claims that crime across America has gone down under the Joe Biden-Kamala Harris regime.
Recently, they've been using an FBI "final" report that claims violent crimes were down 2.1% in 2023.
And the Democrats' claims haven't changed, even though the FBI data has.
In fact, an "update" to that reporting now shows violent crime was up 4.5% over that time period.
A report from Trending Politics explained, "The Biden Justice Department, much like the Biden Labor Department, is quietly amending its crime statistics after posting incomplete data to dispute a key charge that former President Donald Trump has made against Joe Biden."
It continued, "For most of his third campaign for office, President Trump has regularly railed against rising violent crime in the U.S., tying high-profile instances of murder to the millions of new migrants who crossed into the country over the past two years. In response, both Biden and Vice President Kamala Harris have disputed his characterization of crime, and they have been assisted by a mainstream media that has all too often rebutted Trump's assertions, claiming violent crime is down year-over-year. That turned out to be false, according to the FBI."
Real Clear Investigations revealed that the 2.1% figure quickly became – "and remains" – a Democrat talking point against Trump.
But the reality is that the crime was up 4.5%, according to the FBI itself, which now has included new numbers for more murders, more rapes, more robberies, and more aggravated assaults.
The "updated" figures have not been reflected in most media reports, nor in Democrat talking points.
"It's been over three weeks since the FBI released the revised data. The Bureau's lack of acknowledgment or explanation about the significant change concerns researchers," the report said.
"I have checked the data on total violent crime from 2004 to 2022," Carl Moody, a professor at the College of William & Mary who specializes in studying crime, told RealClearInvestigations. "There were no revisions from 2004 to 2015, and from 2016 to 2020, there were small changes of less than one percentage point. The huge changes in 2021 and 2022, especially without an explanation, make it difficult to trust the FBI data."
Real Clear documented, "The actual changes in crimes are extensive. The updated data for 2022 report that there were 80,029 more violent crimes than in 2021. There were an additional 1,699 murders, 7,780 rapes, 33,459 robberies, and 37,091 aggravated assaults. The question naturally arises: should the FBI's 2023 numbers be believed?"
That report noted the Biden-Harris administration has been busy revising other numbers that earlier had made its performance in office look better. For example, the Bureau of Labor Statistics recently confirmed it "overestimated" jobs created … by 818,000.
A City Journal report called out the "mainstream media" for ignoring the updates.
And it faulted the FBI for adjusting numbers "at different times in different ways…"
"Its process is hardly transparent, its results are often inconsistent and poorly explained, and its numbers are frustratingly fluid," the report said.
Trending Politics added, "During last month's debate, President Trump assured viewers that 'crime is up' across the country, prompting Vice President Harris to frown and shake her head. 'Despite the fraudulent statements they made, crime in this country is through the roof. And we have a new form of crime, it's called migrant crime, and it's happening at levels nobody thought possible," Trump said.

One of the first agendas Joe Biden and Kamala Harris pursued when they took office was to open America's southern borders by trashing all of President Donald Trump's security measures, such as wall construction and the "Remain in Mexico" practice.
The result, by now, has been a tripling of child sex trafficking, according to a new report.
It is the Washington Stand that wrote about Free Press investigations that have confirmed that child sex traffickers now routinely use the web, Facebook, TikTok, and OnlyFans, to promote their businesses.
They use "photos of scantily clad women or girls whose faces are not in the photo so that their ages are unclear," the report said.
The documentation says ads for child sex have exploded since Biden and Harris took office, and more than 90% promote sex with migrant children.
"Each week, we track over 12,000 ads for women in Houston, 2,600 in San Antonio, 3,500 in Austin, and 14,000 in Dallas," a source told the publication.
"Nearly all of my sex-trafficking rings now are migrant girls. The ads exploded within the first three months of the border being open. We started noticing new sites and ads in Spanish. That was very few before. Then sites dedicated to Latino girls popped up everywhere."
The traffickers operate this way, the original report said. They are Mexican, Salvadorian, Cuban, and Venezuelan gangs and force women and young girls to cross the border by promising them good jobs in America.
After the crossing comes the prostitution, which traffickers tell them is required to pay off their debts.
The report said sex trafficking is not new, but it has tripled since Biden and Harris took office.
Before Biden and Harris, the government helped some 625 migrant minors who escaped trafficking a year; after they took office it surged to 1,143, then 2,226, and most recently, 2,148 through three-quarters of a year.
The report pointedly noted the Democrat candidate for president, Harris, "During her time in the U.S. Senate, Harris sponsored a bill that would have prevented Immigration and Customs Enforcement (ICE) agents from arresting or deporting illegal immigrants already in the U.S. who claimed to sponsor an 'unaccompanied minor child' (UAC), even if the sponsor had been convicted of crimes such as child sexual abuse."
When the bill failed, she pushed the same language into a Department of Homeland Security funding plan.
