Pundits and politicos on both sides of the aisle have speculated about the possibility that Democrats might pack the U.S. Supreme Court with progressive justices by adding seats to the court if the party gains control of the White House and Senate next month.
Fox News Channel’s Tucker Carlson, however, provided a different take in an on-air monologue, predicting that Democrats could use identity politics as a tool for justifying a court-packing scheme.
“Democrats plan to use identity politics”
Carlson elaborated on the theory during the opening segment of his show on Thursday, the day after Vice President Mike Pence and Democratic challenger Sen. Kamala Harris (D-CA) squared off for a debate.
“The good news is we did learn at least one important new thing from watching,” Carlson claimed, according to Fox. “We learned how Democrats plan to use identity politics going forward.”
A platform based on identity “is an effective way, maybe the most effective way, to get Democrats to the polls in an election year,” he continued.
Those remarks segued into an open question surrounding the Supreme Court.
“If she and [Democratic presidential nominee] Joe Biden win next month, they will indeed pack the Supreme Court,” Carlson said of Harris, according to Fox. “They’ll justify doing that in the name of diversity.”

He went on to speculate that a Biden administration “will tell you the Trump administration is racist for not selecting judges based on the color of their skin.”
The host further suggested that progressives will “tell you that nine is a very racist number of Supreme Court seats” because it had been determined by whites. Both Biden and Harris have been pressed on the issue, including by Pence during Wednesday evening’s debate.
“It’s a pretty simple question,” Carlson said. “It’s a vital question. Political courts are the hallmark of banana republics and dictatorships. We don’t want that here. Yet for weeks, Joe Biden and Kamala Harris have refused to say what they will do if elected.”
The host went on to play a clip from the debate, which demonstrated her once again sidestepping the issue, pivoting instead to the unrelated assertion that none of Trump’s federal appeals court nominees were Black.
“They’ll tell you we need to diversify the court,” Carlson surmised. “And of course, that means a supermajority of partisan Democrats. That’s what they’re going to tell you. For now, they’re not telling you anything, though.”
