For more than two years now, the federal government has used the COVID-19 pandemic as an excuse to garner more power and authority, bypass standard limitations and regulations, and take countless actions it would otherwise be prevented from taking in normal times.
President Joe Biden stirred up plenty of controversies — and perhaps even admitted to illegal and unconstitutional government actions — when he affirmatively declared that “the pandemic is over” in a recent interview, the Conservative Brief reported.
If Biden’s declaration is true that the pandemic is over, then his administration has completely lost its already dubious basis for providing student loan debt relief, to say nothing of myriad other executive decrees and mandates imposed on the citizenry that all stemmed exclusively from the pandemic as a public health emergency.
Biden declaration likely renders student loan debt relief plan illegal and moot
In a “60 Minutes” interview with co-anchor Scott Pelley that aired on Sunday, President Biden said while touring the Detroit Auto Show, “The pandemic is over.” He added, “We still have a problem with COVID. We’re still doing a lotta work on it. It’s — but the pandemic is over. If you notice, no one’s wearing masks. Everybody seems to be in pretty good shape. And so I think it’s changing. And I think this is a perfect example of it.”

The Daily Wire reported that there was swift and immediate backlash from conservatives and independents to what President Biden had said and the broad implications of his declaration regarding the federal government’s pandemic-related emergency actions.
“President Biden’s declaration on 60 Minutes that the pandemic is over — which his administration also argued when ending Title 42 back in May — confirms the illegality of his attempt to transfer hundreds of billions of dollars of student debt to the taxpayer,” National Review’s Charles C.W. Cooke wrote.
Cooke added, “Textually, the OLC’s interpretation of the 2003 HEROES Act was preposterous from top to bottom. But even if one were to cynically ignore all that, the lack of an emergency would render the whole thing moot. Biden just admitted on TV he’s breaking the law.”
Everything that stemmed from the pandemic must now be ended too
The Daily Wire noted that others looked more broadly than just the questionable legality of President Biden’s announced student loan debt relief plans, such as the mask and vaccine mandates and other asserted emergency powers that, in the absence of an actual ongoing pandemic, would all be vulnerable to legal challenges.
Rep. Thomas Massie (R-KY) tweeted Sunday, “If ‘the pandemic is over’ as Biden says, then all of the President’s emergency powers predicated on a pandemic, all COVID vax mandates, the emergency powers of every governor, Emergency Use Authorizations, and the PREP act should all be voided tomorrow.”
Journalist Megyn Kelly was a bit more forward and to the point when she posted, “THE MANDATES MUST END. IMMEDIATELY. ALL OF THEM. And if they don’t, new legal challenges must be filed ASAP.”
Of course, aside from the inevitable legal consequences of Biden’s declaration, he also found himself in a bit of trouble with his own administration, as the White House almost immediately walked back his statement and, according to Politico in mid-August, the Department of Health and Human Services stood poised to once again extend the declared public health emergency — which has been in place since January 2020 — for another 90 days in mid-October, which would serve to continue to justify all of the executive power grabs and mandates and otherwise illegal and unconstitutional actions.
