An audit of the 2020 election in Arizona’s Maricopa County will continue.
The Washington Examiner reports that a judge has just shot down an effort by Arizona Democrats to put a stop to the audit, which will review more than 2.1 million ballots cast in Maricopa County last November.
The audit will also reportedly include a review of the voting machines used in the election, as well as interviews with voters.
Judge hands down ruling
Last week, the Arizona Democratic Party was joined by Steve Gallardo, Maricopa County’s sole Democratic supervisor, in filing a lawsuit in an attempt to block the audit from moving forward. The complainants argued that the audit violates state election laws and regulations.
Judge Daniel Martin, however, wasn’t having it.
On Wednesday, the judge determined that, at least for the time being, there does not appear to be any reason to stop the audit.
“The record presented by plaintiffs, including a number of sworn declarations, contain instances of concerning conduct and expert opinion as to whether the audit complies with law and best practices but no substantive evidence of any breaches or threatened breaches of voter privacy,” Martin said, according to the Arizona Republic.

According to the Washington Examiner, Martin had taken over in the case for Judge Christopher Coury, who recused himself — but not before granting Democrats’ request for a temporary injunction that the Examiner said “was supposed to span over the weekend.”
Democrats “refused to pay a $1 million bond,” however, meaning “the review has been able to proceed as planned” thus far, the Examiner reports.
On Wednesday, Martin explained why he’s not granting the Democrats’ temporary injunction.
“This factor requires a balancing between the Arizona Senate’s constitutional authority to conduct the audit on the one hand and the constitutional rights of voters in Maricopa County to secrecy and confidentiality of information on the other,” Martin said, according to the Examiner. “Given these competing interests, the court cannot say on the present record that one outweighs the other.”
Former President Donald Trump later issued a statement calling the judge’s decision a “big victory” for the GOP. “A highly respected Judge has just ruled that the Forensic Audit being done by the Arizona State Senate can and will continue,” he said, according to the Examiner. Trump added:
